According to the received view, Marxian (ideology) critique and Foucaultian (genealogical) critique constitute two divergent approaches of critical theory that have remarkably different goals and little in common. In this article, however, we identify a guiding thread that connects the Marxian and Foucaultian traditions and motivates a distinctive approach within critical theory we call the ‘critique of constitution’. The problem of restricted consciousness, we show, is the core problem in common between Michel Foucault's critical history of thought and Georg Lukács's (...) theory of reification which underlies the tradition of Western Marxism and Frankfurt School critical theory. The problem concerns the limits of intelligibility and, by the same token, the apparent inevitability of the given social ontology. Our sense of what is possible depends on what we are able to think. But we know from the history of sciences that the limits of intelligibility change, thereby also altering our sense of what is possible. This becomes a political problem in connection with the intelligibility of social reality, because our restricted consciousness limits the alternatives we can so much as consider and seek to bring about. The critique of constitution, then, aims to expand the scope of possibility by revealing the contingent formation of the given limits of intelligibility. We argue that this is the paramount political task for Foucault and Lukács alike, other important differences notwithstanding. (shrink)

Background: Enhancing client autonomy requires close coordination of interactional practices between nurse and client, which can cause challenges when interaction takes place in video-mediated settings. While video-mediated services have become more common, it remains unclear how they shape client autonomy in telehomecare. Research aim: To analyse how video mediation shapes client autonomy when nurses guide medicine taking remotely through video-mediated home care. Research design: This is a conversation analytic case study using video recordings of telehomecare encounters. The theoretical approach draws (...) on ethnomethodology and empirical ethics. Participants and research context: Four home-dwelling older adults and three nurses participated in the data collection; data extracts include one client and two nurses. The study was conducted in Finland. Ethical considerations: Special attention was given to protect the rights of home care clients. An ethical statement for the study was given by the Ethics Committee of the Tampere Region Findings: Video mediation complicates interacting remotely with care-relevant artefacts because of nurses’ limited visual access to the medicine and client’s need to simultaneously engage in vocal interaction and medicine taking. This can be overcome by dividing the guidance into manageable steps which invite the client to explicate their readiness to take the medicine and situating the video-mediation equipment and medicine close together. Different interactional practices and ways of situating video-mediation equipment and medicine have consequences for client autonomy. Discussion: Understanding client autonomy in digitalised settings demands empirical examination that recognises the importance of different human and non-human aspects of care that shape client autonomy. Conclusions: To harness the benefits of video-mediated home care, communication technologies’ reliance on home space and interactional practices should be recognised. Empirical ethics research is needed in order to make normative suggestions that fit a wide variety of care situation. (shrink)

In the Ancient world poverty was a visible and common phenomenon. According to estimations 9 out of 10 persons lived close to the subsistence level or below it. There was no middle class. The state did not show much concern for the poor. Inequality and disability to improve one's social status were based on honour and shame, culture and religion. In order to understand the activity of Jesus and the early Jesus movement in Galilee, it is essential to know the (...) social and economic context where he and his followers came. The principal literary source in first-century Galilee is Josephus, who provides a very incomplete glimpse of the political and economic character of the Galilee and his account is both tendentious and self-serving. There is no consensus among the scholars on the conditions of ordinary people in Galilee at the time of Jesus and the early Jesus movement. The evidence can be interpreted either so that first-century Galilee was peaceful and people had somewhat better times economically because of the large building projects, or just the opposite - the building projects demanded a lot more taxes and forced labour and made life even more difficult. In this article it is argued that the latter conditions explain better the birth and rapid increase of the early Jesus movement in Galilee. (shrink)

In his monumental Philosophy of the Kalam the late Harry Wolfson--truly the most accomplished historian of philosophy in our century--examined the early medieval system of Islamic philosophy. He studies its repercussions in Jewish thought in this companion book--an indispensable work for all students of Jewish and Islamic traditions. Wolfson believed that ideas are contagious, but that for beliefs to catch on from one tradition to another the recipients must be predisposed, susceptible. Thus he is concerned here not so much (...) with the influence of Islamic ideas as with Jewish elaboration, adaptation, qualification, and criticism of them. To this end he examines passages reflecting Kalam views by a wide variety of Jewish thinkers, including Isaac Israeli, Judah Halevi, Abraham ibn Ezra, and Maimonides. As always in Wolfson's work, two aspects are apparent: the special dimensions of Jewish thought as well as its relation to other traditions. And as always his prose is both graceful and precise. For several decades, Antonio Gramsci has been one of the most studied and discussed political theorists; however, his originality as a political thinker has not yet been fully understood. “Altered State of Consciousness” (ASC) has been defined as a changed overall pattern of conscious experience, or as the subjective feeling and explicit recognition that one's own subjective experience has changed. We argue that these traditional definitions fail to draw a clear line between altered and normal states of consciousness (NSC). We outline a new definition of ASC and argue that the proper way to understand the concept of ASC is to regard it as a representational notion: the alteration that (...) has happened is not an alteration of consciousness (or subjective experience) per se, but an alteration in the informational or representational relationships between consciousness and the world. An altered state of consciousness is defined as a state in which the neurocognitive background mechanisms of consciousness have an increased tendency to produce misrepresentations such as hallucinations, delusions, and memory distortions. Paradigm examples of such generally misrepresentational, temporary, and reversible states are dreaming, psychotic episodes, psychedelic drug experiences, some epileptic seizures, and hypnosis in highly hypnotizable subjects. The representational definition of ASC should be applied in the theoretical and empirical studies of ASCs to unify and clarify the conceptual basis of ASC research. (shrink)

Descartes's concept of the mind, as distinct from the body with which it forms a union, set the agenda for much of Western philosophy's subsequent reflection on human nature and thought. This is the first book to give an analysis of Descartes's pivotal concept that deals with all the functions of the mind, cognitive as well as volitional, theoretical as well as practical and moral. During the corona pandemic, politicians have been forced to make urgent decisions under pressure while balancing between challenging options: protecting citizens’ health or causing major social and economic difficulties through security measures. Part of the dilemma has been whether the chosen security measures are oversized, causing fundamental economic and social problems, or not sufficiently enough, thus putting people’s lives at risk. In illustrating our discussion with actions taken by press conferences (PCs) of the Finnish Government, we discuss how nonknowing has (...) governed political decision-making in the corona crisis and how tackling the pandemic has required politicians and experts to develop a capability of dealing with the epistemic conditions of nonknowledge. When information about the virus was constantly updated, the epistemic states of ‘not-yet-known’ or ‘partly-known’ substantially affect the rhythms in which political decisions are made in managing the spread of COVID-19. We suggest that Prime Minister Marin and her cabinet developed a policy of epistemic humility where the legitimation of decision is not based on scientific knowledge but rather on the temporality of nonknowing. The crisis created a favourable momentum for addressing issues of nonknowing in politics, which are easily kept outside of the public attention. (shrink)

Recent developments in artificial intelligence based on neural nets—deep learning and large language models which together I refer to as NEWAI—have resulted in startling improvements in language handling and the potential to keep up with changing human knowledge by learning from the internet. Nevertheless, examples such as ChatGPT, which is a ‘large language model’, have proved to have no moral compass: they answer queries with fabrications with the same fluency as they provide facts. I try to explain why this is, (...) basing the argument on the sociology of knowledge, particularly social studies of science, notably ‘studies of expertise and experience’ and the ‘fractal model’ of society. Learning from the internet is not the same as socialisation: NEWAI has no primary socialisation such as provides the foundations of human moral understanding. Instead, large language models are retrospectively socialised by human intervention in an attempt to align them with societally accepted ethics. Perhaps, as technology advances, large language models could come to understand speech and recognise objects sufficiently well to acquire the equivalent of primary socialisation. In the meantime, we must be vigilant about who is socialising them and be aware of the danger of their socialising us to align with them rather than vice-versa, an eventuality that would lead to the further erosion of the distinction between the true and the false giving further support to populism and fascism. This paper explores Spinoza’s therapy of passions and method of salvation through knowledge and love of God. His optimism about this method is perplexing: it is not even clear how his God, who is unlike any traditional notion of divinity, can be loved. Sorting out Spinoza’s view involves distinguishing an ethics of bondage from another of freedom, and two corresponding notions of love of God. The paper argues that the highest kind of love—‘pure intellectual love of God’—should not be understood (...) as an affect at all, but instead as unimpeded intellectual activity. This suggestion requires reconsidering Spinoza’s account of cognition, particularly his use of the Cartesian notions of objective and formal reality which are not only central to his theory of ideas but constitute the foundations of his salvation project. Hume is famous for his criticism of substantial minds, free will, and self-consciousness—central elements in traditional philosophical accounts of persons. His empiricism dissolves self-inspecting minds into heaps of distinct perceptions and turns cognitive faculties into successions of causally related, discrete impressions and ideas. Whatever regularities the complex ideas and their bundles or heaps display are explained by laws of association of ideas, which are supposed to play the same role in the mental world as Newton’s laws of gravitation play in (...) physical nature. Descartes's view of modality is analyzed by contrast to two earlier models: the ancient realist one, defended by Boethius, where possibility and necessity are connected to natural potency, and the modern intensionalist one, which dissociates necessary and possible truths from any ontological foundation, treating them as conceptual, a priori given preconditions for any intellect. The emergence of this view is traced from Gilbert of Poitiers to duns Scotus, Ockham and Suarez. The Cartesian theory of the creation of eternal truths, it (...) is argued, involves a rejection of this idea of absolute conceivability and can be seen as a constructivist view of intelligibility and rationality. Purpose – The purpose of this paper is to analyse the current status of ownership of patient information from a Lockean perspective and then present Datenherrschaft as a new model for patient ownership of patient information. Design/methodology/approach – This paper is theoretical in approach. It is based on arguments derived from Locke’s Two Treatises of Government. Legal examples of the current situation are derived from Finnish, UK and Swedish legislation. Findings – Current legislation concerning patient information is not clearly formulated (...) and so recognising a new right on the part of the patient, Datenherrschaft, would be an ethically justifiable way of remedying the issue. Research limitations/implications – The legal analysis was limited to Finland, the UK and Sweden, and so other legislation should be looked at in future research. Datenherrschaft is used as an example of an ethically justified way of regulating patient information ownership and should be analysed further. Originality/value – Patient information ownership is an issue that is not unambiguously solved in many countries, nor has it, in our view, been ethically justified. The potential solution presented in this paper is clear and has strong ethical justifications. (shrink)

There are two main strands in the afterlife of Descartes’s famous redefinition of mind in terms of thinking likely to color one’s reading of his notion of mind or self. The one stressed most by his posterity and developed from early on in the empiricist tradition sees consciousness as its main characteristic. The other focuses on reason and rationality. This paper discusses the textual support for the first reading promoted by Ryle and his followers and aligns itself with the second (...) arguing that it is the exercise of its rational, cognitive capacities that are essential to the Cartesian mind and not consciousness, which is merely a presupposition for its rational activity. It examines the interrelation and respective roles of awareness on the one hand, and reason on the other in Descartes’s account of mind or self. But it also suggests that the role given by Descartes to the will in judgment and his separation of will and intellect into two distinct powers may be seen as contributing to a transformation of the very notion of reason and of self as a cognitive and moral agent. This paper reflects on the status of Descartes' notion of the mind-body union as an object of knowledge in the framework of his new philosophy of nature, and argues that it should be taken seriously as representing a third kind of real thing or reality—that of human nature. Because it does not meet the criteria of distinctness that the two natures composing it—those of thinking minds and extended bodies— meet, the phenomena referred to it, which are objects of psychology as (...) traditionally understood, fall outside the scope of clear and distinct perception required for knowledge. The prospects for rationalist psychology are bleak, since because of the mind-body union so little of the contents of the human mind are accessible to rational inspection or introspection. Mechanistic natural philosophy on the other hand gives us knowledge only of the physiological and corporeal aspects of the phenomena Descartes classifies as mental. What pertains to the mind-body union can only be known through the senses, moreover, we learn to conceive the mind-body union only through daily experience (“usant seulement de la vie et des conversations ordinaries”, AT 3, 695). I discuss the nature of this experience, and the sense in which Cartesian psychology without being part of his philosophy of nature in the strict sense of the term, can still be seen as a naturalist undertaking in a more traditional sense of nature where life, sentience, reasoning and rational action are all seen as natural phenomena. It is based on arguments derived from Heidegger’s work in the Being and Time.FindingsBased on this Heideggerian approcah, a proposal for using the special (...) definition of ownership of patient information – Datenherrschaft – given to a patient is suggested. From a Heideggerian perspective, it can be stated that the patient has the strongest rights towards patient information because this information is crucial for a patient to have an understanding about their Dasein.Research limitations/implicationsDatenherrschaft is used as an example of an ethically justified way of regulating the patient information ownership and should be analysed further. Especially the practical implications of implementing Datenherrschaft need more research.Originality/valuePatient information ownership is an issue that is neither unambiguously solved in many countries, nor has it, in our view, been ethically justified. This paper examines Descartes' controversial theory of the creation of eternal truths and the views of modality attributed to Descartes in recent interpretations of it. It shows why attempts to make Descartes' view intelligible by distinctions of different kinds of modality fail to do justice to his theory, which is radical indeed without being incoherent or involving universal possibilism or irrationalism. Descartes' opposition to traditional rationalist views of modality, it suggests, can be seen instead as foreshadowing contemporary views prefixed, logical (...) structure of reality or of the divine intellect. As self-conscious curators and critics of moral history, the early Confucians are relevant to the contemporary debate over the fate of memorials dedicated to morally flawed individuals. They provide us with a pragmatic justification that is distinct from those utilized in the current debate, and in many respects superior to the alternatives. In addition to supplying this curative philosophic resource, the early Confucian practices of ancestral memorialization suggest preventative measures we might adopt to minimize the chances of establishing divisive and (...) oppressive memorials in the future.
